Obama Is Working Behind The Scenes To Undermine Trump

If you believe recent media accounts, the former Democratic president has suddenly transcended the political fray. It’s as if a newly “Zen-like” Barack Obama is content to just write his memoir and let Donald Trump and Republicans write the next chapter of history.

In a cover story asking “Where is Barack Obama?,” for example, New York magazine concluded that the 44th president has “virtually disappeared” from the political scene and is sitting idly by as his legacy is dismantled piece by piece. From an exclusive interview, the periodical concluded Obama was “modeling his political engagement out of office after George W. Bush’s” — that is, staying out of the rough-and-tumble of politics, maintaining distance from his former office and resigning himself to be an elder statesman fading into the sunset.

Don’t buy it.

Obama is doing far more to shape the political landscape than is visible. In fact, for an ex-prez, he’s taking an unusually active role in politics, including helping radical protest groups fight Trump and his policies and devising a scheme to flip the GOP majority in the House and permanently turn red seats blue.

From his sprawling DC office not far from the White House, where he oversees a full-time staff of 20, Obama has held regular meetings with Democratic lawmakers, as well as DNC chief Tom Perez, whom he personally helped install to run the Democratic Party. Obama has also met with his attorney general, Eric Holder, to craft a strategy to redraw congressional district maps in Democrats’ favor, according to Politico. Holder now runs the National Democratic Redistricting Committee, which Obama helped his old friend launch.

Obama, who maintains a home in Chicago, originally said he only planned to stay in Washington temporarily, until his younger daughter, Sasha, now 17, finished high school there. But the family is clearly putting down deeper roots. They recently bought their DC rental home and erected a massive security wall around the property, which includes offices, and are installing a swimming pool.

While it may be true Obama does not want to engage directly in Washington politics, including personally protesting Trump’s policies, he is using a political organizing group he founded to do that for him.

That nonprofit — Organizing for Action — is not exactly a household name. But it is no less than the organizing and training hub of the anti-Trump resistance.

Most recently, OFA helped stage rallies across the country against the administration’s border policies, which it has decried as “cruel and inhumane.” OFA describes itself as a “nonpartisan grass-roots-driven organization,” but it clearly has a pro-Obama agenda. In fact, it’s run almost entirely by alums from Obama’s campaign and White House, including Jon Carson and Jim Messina, who co-chair the group, and Katie Hogan, who serves as its executive director, according to recent tax filings by the nonprofit.

Though Obama has no official or legal role in OFA, he features the group along with his foundation on his post-presidency website and rallies its foot soldiers, who wear blue T-shirts with big white “OFA” letters, in conference calls. After Trump won, for example, he phoned to “fire up” Carson and his team and told them not to worry, that they would “cook up all kinds” of strategies to reclaim the agenda, according to a Nov. 14, 2016, White House transcript of his OFA conference call. More recently, Obama sent an email to “OFA supporters” urging them to “keep going in 2018,” because “there’s simply too much at stake this year.” Obama has tweeted from OFA’s account before and after leaving the White House, and while he was in the White House, he let OFA control his Twitter account, according to The Atlantic.

Earlier this year, moreover, he met with Hogan to discuss how the group can flex its muscles during the midterm campaign to help Democrats recapture the House, according to the New York Times. To that end, OFA plans to train and deploy organizers in 27 Republican-held congressional districts, many with heavy Latino populations, that could be key to a Democratic takeover of the House. With offices in DC and Chicago, OFA has already trained more than 40,000 leftist agitators in person or by webinar, according to tax records.

Behind the scenes, he really may be coordinating the resistance

“We’ve seen grassroots organizing make a big difference this past year, it will again in November,” Hogan recently tweeted.

Meanwhile, OFA has formally partnered with one of the angriest resistance groups, Indivisible Project, which has been criticized for using overly aggressive protest tactics against Republicans at town-hall meetings. Indivisible plans to deploy OFA-trained agitators to storm Republican districts during the Fourth of July recess, starting this weekend, to shout down “Trump’s racist policies,” according to its website.

OFA brings in between $6 million and $14 million in donations a year, and is funded in part by Democracy Alliance, which is connected to the radical group that dispatched agitators to march outside Homeland Security Secretary Kirstjen Nielsen’s Virginia town house, blaring an audiotape of crying immigrant children and chanting “No justice, no sleep!” The group, CREDO Action, also held signs calling Nielsen a “child snatcher” and shouted, “You’re a modern-day Nazi!”

With the help of 40 full-time staffers, OFA trains volunteers in the hard-core tactics popularized by the late Chicago radical Saul Alinsky, including smearing and intimidating opponents and mobilizing angry mobs to convey the appearance of a mass movement that enjoys a good deal of public support.

Alinsky trainers schooled Obama in these same tactics when he was an organizer in South Side Chicago.

Meanwhile, Hogan and OFA have partnered with Obama and Holder’s gerrymandering project to manufacture future Democrat victories.

Republicans are so alarmed by Obama’s permanent presence and political interference, they are raising money from donors based on these fears, warning in a recent fundraising newsletter about “his scheme to interfere in the 2018 midterms,” according to a June 22 email from House Majority Whip Steve Scalise.

In public, Obama has skillfully kept his distance from recent anti-Trump protests and politicking. But behind the scenes, he really may be coordinating the resistance — and acting as its organizer in chief.

No One Can Stop Her… And She Knows It: “This Election Won’t Be Fair”

In a fair election, my best estimate is that Donald Trump would win in a landslide.

But this election will not be fair. In fact, few of them are.

For Trump’s part, there is no doubt that he has been this year’s sensation. A newcomer to politics, he has thrown out all the conventional rules, played by his own, and found a captivated country hanging onto his every word. Love him, hate him, or somewhere in between… no one can look away from the spectacle.

After a war within the party and the convenient disposal of 16 conventional GOP contenders, Trump is now the official Republican candidate and he is in a strong position. Coming out of the relatively calm Republican National Convention and going into the tumultuous DNC, Trump has enjoyed soaring poll numbers while Hillary has been losing ground fast to the scandals and corruption revealed by Wikileaks and other related mouthpieces.

But the fat lady has not sung.

Hijacking the Party, Keeping Dissent Under Wraps

Hillary’s coronation last night as she formally accepted her party’s nomination could hardly have been more forced. The entire Democratic convention has been stage-managed to downplay the overwhelming noise from Bernie supporter who are outraged and feel betrayed by Hillary.

The entire convention has had a certain air to it, a quality that reveals the desperation for power, and the crisp sense of danger that brings with it.

To a casual observer, things might look typical enough, with a few sore losers and pipe dreamers wishing for an ideal country run by decent and fair people that either don’t exist or haven’t figured out how to win an election. But things are not typical – the paradigm is shifting. Politics realigns every 30 years or so, or at least that is the maxim that has held in political science. Only, the last shift has been 30 or 40 years overdue.

There is a reason for that, and the establishment has been fighting to stop the change for the past generation. They have faked out the cycle and kept the population under their thumb (when was the last time you saw a “real” presidential election that wasn’t a means to keeping the status quo?)

But delaying the inevitable won’t hold.

Why Trump Should Win…

As Michael Moore argued, Trump has been preaching the gospel of restoring America’s manufacturing, and is working to woo and turn to “red” the “blue” Rust Belt states where Americans once had strong middle class jobs, especially in Michigan, Ohio, Pennsylvania and Wisconsin. According to Moore’s numbers (which are cited to motivate support for Hillary and opposition to Trump), if Trump captures those key states in addition to the red states that Mitt Romney, a weak candidate, won in 2012, then Trump should win the electoral college:

I believe Trump is going to focus much of his attention on the four blue states in the rustbelt of the upper Great Lakes – Michigan, Ohio, Pennsylvania and Wisconsin. Four traditionally Democratic states – but each of them have elected a Republican governor since 2010 (only Pennsylvania has now finally elected a Democrat). In the Michigan primary in March, more Michiganders came out to vote for the Republicans (1.32 million) that the Democrats (1.19 million). Trump is ahead of Hillary in the latest polls in Pennsylvania and tied with her in Ohio. Tied? How can the race be this close after everything Trump has said and done? Well maybe it’s because he’s said (correctly) that the Clintons’ support of NAFTA helped to destroy the industrial states of the Upper Midwest.

In fact, Moore is right. Nobody wants any more Flint, Michigans (where the water is contaminated and poverty seems to be airborne and contagious), least of all Michael Moore.

Trump’s appeal is much broader than just his sensational antics and controversial statements. He is resonating with America because he is speaking to the wounds of those struggling to cling to what’s left of the middle class American Dream.

And the strength of Trump’s position there is buttressed by the cold fact that the Clinton’s strong support for NAFTA played a major role in the downward spiral of the Rust Belt, and many other parts of the United States.

Trump’s appeal to bringing jobs back to America has to sound like not only a good campaign strategy, but an actual sound idea.

Things have reached a point where nearly every American – regardless of how little they pay attention to news and world affairs – is feeling the damage that has been done. NAFTA, GATT, the WTO and an entire shift into pseudo-governing structures of globalism that have eaten away at the sovereignty of the United States and devoured the prosperity of its people have taken a serious toll on our way of life. And we have all been programmed to take it lying down.

The steady flow of funny money, artificially pumped out by the Federal Reserve has kept many from noticing it, but the real world effects are still hitting people on the street. Not only does the dollar not go as far as it used to, but everything in life is increasing in cost, and getting watered down in value and substance. Society is acting out one big charade, and pretending not to notice the outrage, dissent and anger seeping through the cracks and edges.

Inevitable and determined to win at all costs

Rather than let that burst on her watch, and during the only opportunity she has left in this lifetime, Hillary Clinton and her minions have rearranged all the deck chairs in her favor to force a win. It certainly hasn’t come from the grassroots. Where necessary, the Democratic party has fudged primaries and stolen them outright. The mainstream media has been scripted around her as an anointed figure who is untouchable and beyond reproach. They have stifled exposure of Bernie and would have done so to any other rival… if only any others had dared to enter the race.

Instead, the campaign to elect Hillary became an unrelenting junta to force her into office in spite of the will of the people, the rules of the game or the ever-expanding negative image of the former First Lady, Senator and Secretary of State whose corruption and ties to bad deeds are both legendary and sufficiently documented to warrant life without parole.

There was a never a realistic chance that Hillary would be prosecuted or even reprimanded over her email scandals, because the fix was in a long time ago. Those who would theoretically hold her into account were appointed by her husband, or by President Obama, and their cooperation was assured in private.

Though many have argued that you can’t put lipstick on a pig, that is exactly what has taken place. 2016 is more of a farce than ever… and there is still another round to go.

Only One Persons Stands Between Her and the Presidency

Can anyone else see that the most rigged and stolen election of all time is shaping up? If the Democratic party doesn’t want Hillary, what makes anyone think the entire country wants anything to do with her?

Before you answer that openly, make a strong educated guess about who the next president is going to be… and how many bodies she will have to climb over to get there.

What Wikileaks exposed with Debbie Wasserman Schultz and the DNC, and what the emails have revealed about Hillary and the Clinton Foundation are surely only the tip of the iceberg. The stories of the delegates who were silenced or kicked out of the convention, and many other deceitful acts to destroy dissent and keep up appearances suggest some of the rest of the story… and it is anything but democratic or “of the people” – though very likely the whole of it will never be known.

There is something very, very wrong going on and it is time that everyone – regardless of ideology, party affiliation or politics – needs to face up to. Preliminary evidence indicates strongly that there has been a very carefully orchestrated coup taking place… and if successful, it will have only one logical conclusion:

Total power, at any price, with a facade of support and momentum that just isn’t there from anyone other than a handful of elite billionaires, and a cadre of clients with addresses that are either foreign or based on Wall Street.

If you missed the convention coverage, then you have got to see Hillary playing with the balloons after her speech.

There really is no wondering who she is concerned about… herself, of course.

As I mentioned above, it is reminiscent – even spot on – of Charlie Chaplin’s amazing parody in The Great Dictator, where his version of a Hitler-esque autocrat toys with the world as his plaything.

We are in for a world of hurt if what I think is going to happen turns out. The entire democratic process is being pushed back under the water, and a crude, fake smile is broadcast for appearances, while holding it all down.

If you MUST  show your identification to board an airplane, cash a check, buy liquor,  or check out a library book and rent a video, but not to vote for who runs  the government — you might live in a nation that was founded by geniuses  but is run by idiots.

If the  government wants to prevent stable, law-abiding citizens from owning gun  magazines that hold more than ten rounds, but gives twenty F-16 fighter  jets to the crazy new leaders in Egypt — you might live in a nation that  was founded by geniuses but is run by idiots.

If, in the  nation’s largest city, you can buy two 16-ounce sodas, but not one  24-ounce soda, because 24-ounces of a sugary drink might make you fat —  you might live in a nation that was founded by geniuses but is run by  idiots.

If an  80-year-old woman or a three-year-old girl who is confined to a wheelchair  can be strip-searched by the TSA at the airport, but a woman in a burka or  a hijab is only subject to having her neck and head searched — you might  live in a nation that was founded by geniuses but is run by  idiots.

If your  government believes that the best way to eradicate trillions of dollars of  debt is to spend trillions more — you might live in a nation that was  founded by geniuses but is run by idiots.

If a  seven-year-old boy can be thrown out of school for saying his teacher is  “cute,” but hosting a sexual exploration or diversity class in grade  school is perfectly acceptable — you might live in a nation that was  founded by geniuses but is run by idiots.

If hard  work and success are met with higher taxes and more government regulation  and intrusion, while not working is rewarded with Food Stamps, WIC checks,  Medicaid benefits, subsidized housing, and free cell phones — you might  live in a nation that was founded by geniuses but is run by  idiots.

If the  government’s plan for getting people back to work is to provide incentives  for not working, by granting 99 weeks of unemployment checks, without any  requirement to prove that gainful employment was diligently sought, but  couldn’t be found — you might live in a nation that was founded by  geniuses but is run by idiots.

If you pay  your mortgage faithfully, denying yourself the newest big-screen TV, while  your neighbor buys iPhones, time shares, a wall-sized do-it-all plasma  screen TV and new cars, and the government forgives his debt when he  defaults on his mortgage — you might live in a nation that was founded by  geniuses but is run by idiots.

If being  stripped of your Constitutional right to defend yourself makes you more  “safe” according to the government — you might live in a nation that was  founded by geniuses but is run by idiots.

Meet Directive 3025.18 Granting Obama Authority To Use Military Force Against Civilians

While the “use of armed [unmanned aircraft systems] is not authorized,The Washington Times uncovering of a 2010 Pentagon directive on military support to civilian authorities details what critics say is a troubling policy that envisions the Obama administration’s potential use of military force against Americans. As one defense official proclaimed, “this appears to be the latest step in the administration’s decision to use force within the United States against its citizens.” Meet Directive 3025.18 and all its “quelling civil disturbances” totalitarianism…

As The Washington Times reports,

Directive No. 3025.18, “Defense Support of Civil Authorities,” was issued Dec. 29, 2010, and states that U.S. commanders “are provided emergency authority under this directive.”

“Federal military forces shall not be used to quell civil disturbances unless specifically authorized by the president in accordance with applicable law or permitted under emergency authority,” the directive states.

“In these circumstances, those federal military commanders have the authority, in extraordinary emergency circumstances where prior authorization by the president is impossible and duly constituted local authorities are unable to control the situation, to engage temporarily in activities that are necessary to quell large-scale, unexpected civil disturbances” under two conditions.

The conditions include military support needed “to prevent significant loss of life or wanton destruction of property and are necessary to restore governmental function and public order.” A second use is when federal, state and local authorities “are unable or decline to provide adequate protection for federal property or federal governmental functions.”

A U.S. official said the Obama administration considered but rejected deploying military force under the directive during the recent standoff with Nevada rancher Cliven Bundy and his armed supporters.

“Federal action, including the use of federal military forces, is authorized when necessary to protect the federal property or functions,” the directive states.

Military assistance can include loans of arms, ammunition, vessels and aircraft. The directive states clearly that it is for engaging civilians during times of unrest.

There is one silver lining (for now)…

“Use of armed [unmanned aircraft systems] is not authorized,” the directive says.

“Nuclear Option” Does Enable Democrats To Ensure One-Party Authoritarian Control of Health Care

Last week, I explained that the U.S. Senate’s deployment of the “nuclear option” — lowering the threshold for approval of non-Supreme Court presidential nominees from 60 votes to 51 votes — does not make it easier for President Obama to use ObamaCare’s Independent Payment Advisory Board. I need to add this caveat: during his tenure. The nuclear option does enhance the ability of the president and his party to control the health care sector well after he leaves office.

It’s true that the rules change will make it easier for the president to have his IPAB nominees approved by the Senate, particularly through January 2015, when the Democratic caucus holds 55 seats. But if the president and Senate fail to seat anyone on the IPAB, the board’s sweeping legislative powers fall to the Secretary of Health and Human Services. If President Obama wants to use IPAB’s powers during his term, therefore, he need only retain Kathleen Sebelius as his HHS secretary.

ObamaCare permits IPAB to exercise its powers, however, only if Medicare’s actuaries project the program’s outlays will grow faster than a specified rate. A number of readers note that Medicare’s actuaries reported earlier this year that their projections currently do not show Medicare spending exceeding that target rate, and that their projections likely will not do so during the remainder of President Obama’s term. Those projections and the resulting determination could change next year. If so, and if the president and Senate have not placed confirmed any IPAB members, Secretary Sebelius could use IPAB’s powers during President Obama’s term. Those powers include the ability to raise taxes, to ration care to Medicare enrollees, and to appropriate funds to her own department, without the consent of the people’s elected representatives. (Critics will object that IPAB has none of these powers. In this study, Diane Cohen and I explain why we think they are incorrect.) Sebelius’ “proposal” would take effect during 2016.

Regardless of whether Medicare’s actuaries pull that trigger, however, President Obama and Senate Democrats face a huge incentive to nominate and confirm as many IPAB members as they can, as quickly as they can: with the nuclear option, Democrats now have it within their power to ensure Democratic control of IPAB — and with it, essentially the entire health care sector — at least through the first term of President Obama’s successor and the next three Congresses, even if Republicans capture the presidency, retain the House, and take control of the Senate. Consider.

  • Despite requirements that the president consult with the leaders of both parties in Congress on his IPAB picks, there is no obligation for the president to select members from both parties. The president can stack IPAB entirely with members of his own party and ideological persuasion.
  • IPAB members serve terms that are nominally six years, but actually serve until they are replaced. So a board member who is confirmed in 2014 will serve at least through 2020, and possibly longer.
  • If President Obama and Senate Democrats seat even one IPAB member, they can maintain Democratic control of IPAB for as long as they retain control of the Senate. If a Republican wins the White House in 2016, the fact that there is one sitting IPAB member is enough to prevent a Republican HHS secretary (Paul Ryan, maybe?) from wielding IPAB’s powers. Only one member need be seated for the “board” itself to do business. A Democratic Senate could then keep that one-member IPAB 100-percent Democratic by blocking any Republican nominees to the board.
  • If President Obama and Senate Democrats seat only eight IPAB members, they will guarantee a Democratic majority on the board through at least 2020 (and beyond if they then control the Senate and/or the presidency).
  • If President Obama and Senate Democrats seat all 15 IPAB members, his successor will not be able to appoint any members during her first term. Even if Republicans take the White House and the Senate. Nor would a Republican successor be able to remove any Obama appointees. The president may remove IPAB members “for neglect of duty or malfeasance in office, but for no other cause.”

Here’s where things get scary.

ObamaCare mandates certain procedures that Congress must follow if it wants to overrule IPAB’s, ahem, “proposals.” The people’s elected representatives must clear certain hurdles — some as high as IPAB wishes to set them — if they want to retain their authority as the ones who write laws regarding health care. (The Congress that enacted ObamaCare had no lawful power to enact such requirements, but no matter. George F. Will writes that Diane Cohen and I “well described” IPAB as “the most anti-constitutional measure ever to pass Congress.”)

As Cohen and I report, during the first term of President Obama’s successor, Congress loses even those limited powers to restrain IPAB:

Worse, if Congress fails to repeal IPAB through the restrictive procedure laid out in the Act, then after 2020, Congress loses the ability even to offer substitutes for IPAB proposals…To constrain IPAB at all after 2020, Congress must repeal it between January and August in 2017.

Though this will be news even to most health policy wonks, I won’t explain here how ObamaCare produces this frightening result. I refer readers instead to the Cohen-Cannon study.

But the upshot is this. To the extent Democrats use the nuclear option to pack IPAB with Democratic appointees in 2014, and are able to retain the White House or the Senate in 2016 and beyond, they will be able to ensure one-party authoritarian control of the U.S. health care sector. That’s not just unfair or partisan or economically inefficient or unconstitutional. It’s also undemocratic.

The Scheme behind the Obamacare Fraud

Lies smooth the transition to a fundamental transformation of our health-care system.

Fraud can be so brazen it takes people’s breath away. But for a prosecutor tasked with proving a swindle — or what federal law describes as a “scheme to defraud” — the crucial thing is not so much the fraud. It is the scheme.

To be sure, it is the fraud — the individual false statements, sneaky omissions, and deceptive practices — that grabs our attention. As I’ve recounted in this space, President Obama repeatedly and emphatically vowed, “If you like your health-insurance plan, you can keep your health-insurance plan, period.” The incontrovertible record — disclosures by the Obama administration in the Federal Register, representations by the Obama Justice Department in federal court — proves that Obama’s promises were systematically deceitful. The president’s audacity is bracing, and not just because he lies so casually while looking us in the eye. Obama also insults our intelligence. It is one thing to tuck evidence of falsehood into a few paragraphs on page 34,552 of a dusty governmental journal no one may ever look at. It is quite something else to announce it in a legal brief publicly filed in a case of intense interest to millions of Americans aggrieved by Obamacare’s religious-liberty violations. To be so bold is to say, in effect, “The public is too ignorant and disengaged to catch me, and the press is too deep in my pocket to raise alarms.”

Still, to show that politicians lie is like pointing out that it gets dark at night. The lie, the fraud, does not tell us why they lied in this instance. The fraud does not tell us what the stakes are. To know that, we must understand the scheme — the design.

The point of showing that Obama is carrying out a massive scheme to defraud — one that certainly would be prosecuted if committed in the private sector — is not to agitate for a prosecution that is never going to happen. It is to demonstrate that there is logic to the lies. There is an objective that the fraud aims to achieve. The scheme is the framework within which the myriad deceptions are peddled. Once you understand the scheme, once you can put the lies in a rational context, you understand why fraud was the president’s only option — and why “If you like your plan, you can keep your plan” barely scratches the surface of Obamacare’s deceit.

In 2003, when he was an ambitious Illinois state senator from a hyper-statist district, Obama declared:

I happen to be a proponent of a single-payer universal health-care program. I see no reason why the United States of America, the wealthiest country in the history of the world, spending 14 percent of its gross national product on health care, cannot provide basic health insurance to everybody. . . . Everybody in, nobody out. A single-payer health care plan, a universal health care plan. That’s what I’d like to see. But as all of you know, we may not get there immediately.

That is the Obamacare scheme.

It is a Fabian plan to move an unwilling nation, rooted in free enterprise, into Washington-controlled, fully socialized medicine. As its tentacles spread over time, the scheme (a) pushes all Americans into government markets (a metastasizing blend of Medicare, Medicaid, and “exchanges” run by state and federal agencies); (b) dictates the content of the “private” insurance product; (c) sets the price; (d) micromanages the patient access, business practices, and fees of doctors; and (e) rations medical care. Concurrently, the scheme purposely sows a financing crisis into the system, designed to explode after Leviathan has so enveloped health care, and so decimated the private medical sector, that a British- or Canadian-style “free” system — formerly unthinkable for the United States — becomes the inexorable solution.

Once you grasp that this is the scheme, the imperative to lull the public with lies makes sense. Like all swindles, Obamacare cannot work if its targeted victims figure out the endgame before it is a fait accompli.

The president is a community organizer in the Saul Alinsky tradition. He is trained to adopt the language and co-opt the sensibilities of the masses in order to become politically viable; then, once raw power is acquired, the Alinskyite uses every component of it to thwart opposition in patient but remorseless pursuit of the given “social justice” goal. Consequently, in pursuit of health-care statism, Obama moderated his rhetoric over the years, but not his ideological goals. He stressed pragmatism: a gradual campaign that kept the ultimate prize in sight. “I don’t think we’re going to be able to eliminate employer coverage immediately,” he told his hard-Left base at a 2007 SEIU health-care forum. “There’s going to be potentially some transition process. I can envision a decade out or 15 years or 20 years out.”

There’s that word: transition. It’s the route “change” takes to reach its final destination: “fundamental transformation.” If you’re paying attention, you’ll hear the word transition a lot in Obama’s health-care speeches. You’ll also find it in that Justice Department brief the administration no doubt wishes Eric Holder’s minions had edited more furtively:

The [Affordable Care Act’s] grandfathering provision’s incremental transition does not undermine the government’s interests in a significant way. Even under the grandfathering provision, it is projected that more group health plans will transition to the requirements under the regulations as time goes on. [Officials of the Department of Health and Human Services] have estimated that a majority of group health plans will have lost their grandfather status by the end of 2013 [emphasis added].

Understand what this studiously unthreatening, gradualist gobbledygook means. A “group health plan” is employer-provided insurance; the phrase thus blithely refers to the “transition” of 156 million Americans who get health insurance for themselves and their families through work. It does not mention the so-called individual market, consumers who buy health insurance on their own. That’s because the administration assumes the “transition” of those 25 million Americans from their preferred plans to Obamacare will already have progressed well toward completion. And indeed it has, as we have seen in the millions of cancellation notices reported in the last six weeks.

The Justice Department’s assertion, based on the administration’s internal analyses, conveys that by the third year of Obamacare’s implementation — “the end of 2013,” which has since been extended by a year due to Obama’s “waiver” of the employer mandate — more than half of those 156 million group policies will have lost their “grandfather status.” “Grandfathering” is the mirage Obama projected for his illusory “if you like your plan, you can keep your plan” guarantee.

You couldn’t keep your plan because Obamacare mandates made it impossible for private insurers to offer it. The mandates essentially require that everything and everyone be covered — even though you do not need coverage for everything (e.g., 23-year-old men do not need birth-control pills, neo-natal care, and periodic colonoscopies), and even though mandatory coverage for preexisting conditions is not insurance but welfare. The mandates are simply cost-shifting from the young and healthy to the older and sicklier — just as you would find in any universal, single-payer system. But Obamacare is camouflaged to make it look like the insurers are deciding not to offer your plan anymore, rather than that the government is forcing their hand.

Of course, that’s not the half of the deceit — not in a program the president publicly insisted was not a tax even as his Justice Department insisted to the Supreme Court that it was one. Obama also said, “If you like your doctor, you will be able to keep your doctor, period.” As Hot Air’s Ed Morrissey noted this week, that promise too is fraudulent. If your doctor is not part of the network offered on the plans in your exchange, you will lose your doctor. To keep costs down, exchanges will limit their provider networks. Top doctors and hospitals are already being cut out. Moreover, the onerous regulations, reporting requirements, and constant threat of fee-slashing are beginning to drive doctors out of the profession.

Then there is the Independent Payment Advisory Board. Stanley Kurtz described the IPAB in all its frightening detail in a 2011 National Review cover story: “An unelected and unaccountable bureaucratic entity with nearly limitless power over federal Medicare spending, [it] will have the power to effectively ration health care through price controls.”

Put aside that the IPAB, which Obamacare insulates from judicial review, is an unconstitutional delegation of Congress’s legislative power — a model that, if adopted in spheres of activity beyond health care, would effectively end popular self-governance. As the rising costs driven by our health-care system’s suffocating regulations compound our astronomical debt, pressure is mounting for the IPAB to oversee cost-cutting — i.e., rationing — not only in Medicare but across the whole Obamacare framework. In fact, as Stanley recounts, the bipartisan Simpson-Bowles commission appointed by Obama made just such a recommendation — giving the president political cover to push hard for IPAB expansion. “Once IPAB’s rules govern America’s health-care system as a whole,” Stanley concludes, “we will be most of the way down the road to a British-style single-payer system.”

So how does Obama get all the way down that road? That is where the scheme’s manufactured crisis comes in. Obamacare commands that all Americans purchase health insurance, whether they want it or not. This is essential: If young healthy people refused to buy overpriced, largely superfluous coverage to underwrite the cost of insuring older and sick people, premiums would further skyrocket. As Powerline’s John Hinderaker explains, insurance companies would either have to fold or shift the costs to whatever employer plans still remained. This, in turn, would spur employers to cancel plans, dumping ever more people into the government exchanges.

The individual mandate is what is supposed to prevent that death spiral. There’s just one thing: The individual mandate is legally unenforceable.

Yes, there is a penalty for failing to purchase insurance — starting at $95 or 1 percent of income the first year and rising sharply thereafter. But the designers of Obamacare went out of their way to prohibit the IRS from using its usual array of civil and criminal processes (fines, liens, etc.) to confiscate it. The government may only collect the penalty by deducting it from tax refunds — meaning people who prudently structure their tax withholding so that no refund accumulates can avoid paying with impunity.

Obviously, it would be far less expensive for young people — who are already disproportionately strained by Obama’s no-growth, high-unemployment economy — to opt for a penalty they are not actually required to pay than to purchase prohibitively costly coverage. After all, under Obamacare, they can wait until they are sick to buy “insurance.” That is, Obamacare’s architects consciously created the incentive to destroy the program’s own insurance exchanges.

By the time that problem erupts, private insurance will already be gutted. Coverage requirements will already be dictated by government, as will pricing, with a subsidy structure that builds in progressive wealth redistribution. And doctors will already be beholden to government for patient access, treatment options, record-keeping requirements, and payment. That is, much of the single-payer infrastructure will be in place.

The manufactured financial crisis will be portrayed as a demonstration that exchanges based on the assumption that individuals will take responsibility for their own “private” insurance arrangements do not work. It will be time to solve the crisis by a seamless transition — there’s that word again — to a fully socialized health-care system, now overtly controlled by the government. “Free” health care for everyone — with all the substandard treatment, absurd wait times, and rationing that entails — will be supported by a few “tweaks” to our progressive tax system . . . no more unwieldy, unpredictable premium payments.

That’s the scheme. Or maybe you still believe that if you like your private medical system, you can keep your private medical system, period.

Obamacare ‘fix’ affirms Obama as absolute dictator with power to change laws as he pleases

(NaturalNews) In a desperate bid to save the rapidly collapsing Obamacare socialized medicine program, President Obama announced a “fix” yesterday that would “allow” health insurance companies to avoid cancelling whatever plans haven’t already been cancelled due to Obamacare itself.

In doing so, Obama effectively declares himself absolute dictator over all laws across the country, assuming the power to enforce, ignore or alter laws at he pleases.

The problem with this is that such powers do not exist in the Office of the President. Like everything else surrounding Obamacare, Obama himself is simply inventing new powers as he goes along and hoping no one will question his assumed (illegal) authority.

“The unexpected compromise was announced amid growing revolt within Mr. Obama’s own party over his broken promise that Americans who liked their insurance could keep it. But it sparked another backlash as some legal scholars questioned whether the president had the authority to create the loophole,” reports the Washington Times.

It also, by the way, thrust the insurance industry into a state of chaos where insurance companies now have no idea what’s going to be “law” tomorrow, next month or next year. Apparently Obama can simply change his mind at any time and decide that insurance companies are suddenly engaged in mass criminal activities which can then be prosecuted under the law as it is written.

Beware of presidents who claim absolute power over Congress

This is how Hitler rose to power, of course. It’s how every tyrant throughout history got his start. It’s also precisely what the United States Constitution prohibits in Article II, Section 3, where the language demands that the President “take care that laws be faithfully executed.”

Nowhere in the Constitution does it say any President can simply choose to selectively ignore laws passed by Congress. Thus, Obama’s new “fix” is blatantly illegal from the start.

Even if it were legal under the U.S. Constitution, it is clearly discriminatory, allowing the White House to essentially decide which insurance companies “get” to be ignored by the law and which companies will be prosecuted for “illegally” keeping policies in place that violate the Affordable Care Act as written. This only creates yet more centralization of power in the White House, giving them the tools to silence dissent among insurance companies by wielding prosecutorial discretion as a political weapon.

Obama unleashes economic despair and market chaos on America

The health insurance industry is now suffering from a case of regulatory whiplash. Obama’s enforcement of federal law seems to change with the direction of the wind, and his highly irresponsible, immature actions are causing extreme market destabilization.

At this point, insurance companies have no idea what to believe. Nor do consumers who are shopping for plans. Healthcare.gov remains in a disastrous state and even though Obama has now announced his unconstitutional “fix” for people to keep their health care plans, there exists no government-legalized mechanism for insurance companies to reinstate policies already cancelled!

Thus, all the policies already cancelled are dead and gone forever. So it’s not even clear how Obama’s so-called “fix” helps anyone at all.

Like everything else in the Obama administration, this “fix” is nothing more than deceptive smooth talking to gloss over a problem and promote the delusion that everything is working just fine.

Obama’s campaign promise of “hope and change” has become a joke. Sometimes hope is little more than false hope pretending to be real. And sometimes, the most charming, slick talking salesman is actually a con artist. Kevin Trudeau is in prison right now for lying about a weight loss book. Obama lied to the whole country about a far more serious issue, and he gets rewarded with even more power in his unconstitutional effort to “fix” the very problem he caused in the first place.

Progressives Made Their Beds; It’s Time They Lay In It

Throughout the government shutdown, Democrats, who knew Republicans wouldn’t be able to delay Obamacare, routinely said, “It’s settled law.” President Obama was re-elected, they say – though he said almost nothing about Obamacare during the campaign, and what he did say amounted to platitudes he knew were false. And the Supreme Court ruled it constitutional.

The debate was over, progressives crowed. It was going to happen. Soon they will be eating crow, and Republicans have to position themselves smartly and strategically now to make sure that crow is served up to them on a silver platter.

The roll out of Obamacare has been a disaster that makes “New Coke” look like the iPad. The website rarely works, and when it does, it sends incorrect information to insurers. And when young and healthy people do sign up, they discover they’re going to be paying exponentially more for insurance to subsidize premiums for wealthy retirees.

That last one should stick in the craw of everyone under 35. They will be paying thousands of dollars per year more so retirees who technically have no income but own their homes and are living off savings and investments – which don’t count as income when it comes to subsidies for the “poor.” And they will be paying for this until they reach 65 and go on Medicare, at which point still younger people will be subsidizing them.

In short: Obamacare is a massive wealth “spreading” from the young and struggling to the old and well off.

Add to that Obamacare’s devastating impact on the economy and part-timing of the American workforce, and you can almost see the train flying off the rails.

There will be attempts at bi-partisan “fixes” to some of the more visible problems caused by Obamacare. Republicans and Democrats have been working together to delay or repeal the medical device tax and change the definition of a full-time employee back to 40 hours per week from Obamacare’s 30 – to name just two.

Republicans must resist the urge to help with these “fixes.”

We just spent a month being lectured by arrogant know-it-alls about how Obamacare is “settled law.” So keep it settled.

Obamacare is failing already, and it will continue to fail in more spectacular ways as we move forward, let it.

Democrat wrote the bill, Democrats voted for the bill, a Democrat president signed it into law. It’s theirs. Make them live with it. As is.

Do not change one comma, one letter. It’s settled law! This is what they wanted, this is what people voted for. If the full failure of Obamacare isn’t allowed to happen, if “fixes” are passed, it will live on in a money-sucking spiral of destruction that will lead to a complete and total government takeover of health care in this country – which is their goal.

It’s going to be painful, but it’s also going to be quick. And the pain will be nothing compared to the damage to the economy and our future if this Frankenstein’s monster is helped to limp into permanency.

Meanwhile, this is also a chance for conservative groups to flex their muscles (and ample money) in a non-circular firing squad way. I have to address them directly now.

Set up a website as a clearinghouse for Obamacare failure stories.

I know you don’t play nice with each other, but get over it. One website, not competing websites – and the focus has to be spreading these collected stories to the media, both national and local. I know you love adding to your email lists, but this can’t be about that. This has to be about spreading the truth the media will do its damnedest to ignore.

Gather stories from any source possible, including user-submitted. Verify them and record the actual people going through them on video in 30- and 60-second clips. Then blast them out daily to every local media outlet in their area. And post new ones on the site daily. Go around the media like President Reagan used to. Overwhelm them into covering the truth.

It’s going to take money, but this can’t be a fundraiser for you. Asking people for money is understandable in normal circumstances, but this is not a normal circumstance. Collect stories, film them and get them out there – that is the only purpose here. If you want to win, that is. If you’d rather be the voice of the conservative movement or the Tea Party group, then that’s your priority – not making the country a better place – and I can’t help you.

Republicans have to be united. Conservatives have to be united. If done right, this effort will have no spokesman on TV. It will be a conduit for getting real people with real Obamacare horror stories in front of any camera, at any time, anywhere in the country. It will be a major undertaking, a massive database and possibly the most important thing any or all of you can do over the next year.

Progressives are unified and indignant. They are indifferent to the cost to both the country and individual, and the pain to the individual is, to them, irrelevant. This is about the concept.

To protect their agenda, they will highlight any success story, no matter how dubious. Conservatives must beat them at their own game. They trot out personal stories constantly; we must do the same. If the president gives a speech touting Obamacare in Fresno, Calif., every reporter within 100 miles should be served up a menu of people suffering under it before Air Force One touches the ground.

This is a winnable fight. It’s our fight to win. But if there’s one thing Republicans and conservatives excel at, it’s snatching defeat from the jaws of victory.

Obamacare is a disaster, not just in code on a website, but in concept and construction. It survives if we allow it to survive. No more delays, no more defunds, and no more changes. Every unconstitutional change the president makes must be immediately met with a court challenge, even if it’s good. It’s his law. It’s his “medicine.” Make him take it.
